UMass Law Professor Jeremiah Ho’s upcoming article, Queer Sacrifice in Masterpiece Cakeshop, will be published in a forthcoming edition of the Yale Journal of Law & Feminism. The article interprets the Supreme Court’s 2018 decision in the case of Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Commission, which found in favor of a baker who refused to sell a wedding cake to a same-sex couple. Professor Ho discusses how the Masterpiece Cakeshop case demonstrates that, when the LGBTQ litigants’ sexual identities seem less assimilated and more destabilizing to the status quo, the Court is much less inclined to protect them from discrimination and, in turn, reacts by reinforcing its interest to preserve the status quo—one that relies on religious freedoms to fortify heteronormativity.
